In the past ten years, there has been growing interest in and concern about protecting the privacy of personal medical information. Insofar as medical records increasingly are stored electronically, and electronic information can be shared easily and widely, there have been legislative efforts as well as scholarly analyses calling for greater privacy protections to ensure that patients can feel safe disclosing personal information to their health-care providers. At the same time, the volume of biomedical research conducted in this country continues (...) to grow. The budget of the National Institutes of Health, for example, was $20,298 million in 2001, having more than doubled from a budget of $9,218 million 10 years before. This growing body of research includes increased efforts to use stored medical records as a source of data for health services, epidemiologic, and clinical studies. (shrink)

Neural substrates of fatigue in traumatic brain injury are not well understood despite the considerable burden of fatigue on return to productivity. Fatigue is associated with diminishing performance under conditions of high cognitive demand, sense of effort, or need for motivation, all of which are associated with cognitive control brain network integrity. We hypothesize that the pathophysiology of TBI results in damage to diffuse cognitive control networks, disrupting coordination of moment-to-moment monitoring, prediction, and regulation of behavior. We investigate the cingulo-opercular (...) and frontoparietal networks, which are engaged to sustain attention for task and maintain performance. A total of 61 individuals with mild TBI and 42 orthopedic control subjects participated in functional MRI during performance of a constant effort task requiring altering the amount of effort utilized to manually squeeze a pneumostatic bulb across six 30-s trials. Network-based statistics assessed within-network organization and fluctuation with task manipulations by group. Results demonstrate small group differences in network organization, but considerable group differences in the evolution of task-related modulation of connectivity. The mild TBI group demonstrated elevated CO connectivity throughout the task with little variation in effort level or time on task, while CO connectivity diminished over time in controls. Several interregional CO connections were predictive of fatigue in the TBI group. In contrast, FP connectivity fluctuated with task manipulations and predicted fatigue in the controls, but connectivity fluctuations were delayed in the mild traumatic brain injury group and did not relate to fatigue. Thus, the mTBI group’s hyper-connectivity of the CO irrespective of task demands, along with hypo-connectivity and delayed peak connectivity of the FP, may allow for attainment of task goals, but also contributes to fatigue. Findings are discussed in relation to performance monitoring of prediction error that relies on internal cues from sensorimotor feedback during task performance. Delay or inability to detect and respond to prediction errors in TBI, particularly evident in bilateral insula-temporal CO connectivity, corresponds to day-to-day fatigue and fatigue during task performance. Cases of severe and enduring Anorexia Nervosa (SEAN) rightly raise a great deal of concern around assessing capacity to refuse treatment (including artificial feeding). Commentators worry that the Court of Protection in England & Wales strays perilously close to a presumption of incapacity in such cases (Cave and Tan 2017, 16), with some especially bold (one might even say reckless) observers suggesting that the ordinary presumption in favor of capacity ought to be reversed in such cases (Ip 2019). -/- Those (...) of us who worry that such trends and proposals amount to (or at least pose a serious threat of) wrongful discrimination on the grounds of disability nevertheless feel the pull of judging many SEAN service users to be incapacitous with respect to decisions regarding (perhaps amongst other things) treatments involving feeding, artificial or otherwise. But it is difficult to get to grips with exactly what their incapacity consists in. Many such service users seem able to understand, retain, use and weigh information, and express a decision (i.e. they seem, prima facie, to satisfy the ‘MacArthur’ criteria). The focus of this article will be on inserting the words of older women in prison into debates on time, agency and gendered identities in total institutions. Specifically, the article will address the complexity and contradictions of the time of ‘a mediated real’, and how this impacts on embodied identities within prison timescapes. This will be explored through looking at how prison-time as a ‘somatic identity cipher’ functions performatively in the construction of older women’s identities. The article will also examine (...) how female elders in prison become agents and negotiate techniques of discipline. The role of prison-time will be shown to be simultaneously experienced as further punishment while also being resisted as we draw out the relationship between temporality, spaces of incarceration and identification. First, we will locate the field in terms of issues of theory and method. Then we will look at performativity, identity and time in negotiating, acquiescing to and resisting the identity ‘prisoner’. This will enable us to understand the role and meaning of time in relation to how females in prison are compelled to reiterate and negotiate the identity ‘prisoner’ within the discipline of ‘the time of incarceration’. We hope to demonstrate through the voices of the women that there is no single abstract imprisoned body. These are real bodies, fleshy, sensate bodies that experience real pain; at the same time, these bodies are not simply given but also interpreted, mediated and in part constituted in social and cultural meanings. This enables us to show that the body can be both a generator and receptor of meanings. (shrink)

This workshop unearths the potential of applying principles of cybernetics to curriculum and educational technology design. Here, we focus on using technology-assisted learning scenarios at the confluence of education, psychology, and computer science as an asset for adults to learn the skills for critical Internet navigation; skills we argue are an integral part of life in the Information Age. The first part of the workshop begins with an introduction to what von Foerster called Gordon Pask’s first theorem (a basic framework (...) of human-tool conversations), which was used to design classes in heuristics at the University of Illinois, Urbana, and involved project-based community and artefact development. It then describes how this approach was replicated to co-design educational psychology classes at The Ohio State University in 2022-2023 to help preservice teachers engage in metareflection about their future careers. A small group discussion between workshop participants follows to understand how tools and activities used in these classes (social media, block programming, co-authoring, podcasting) can be adapted for other subject classrooms. The second part of the workshop focuses on fine-tuning the build of educational technologies like search engines to spur concept development. -/- We invite volunteers to interact with our Paskian search engine, ThoughtShuffler, which uses an uncertainty regulation mechanism to organize search results for lateral reading, and present results from an experimental study showing the tool has the potential to engender higher-order reflectivity in information search. We suggest principles of cybernetics can be used to co-design sociotechnical systems and sharpen both human and machine functioning within them, presenting hopes for human adaptation to an information-saturated future. The central purpose of the paper is to elucidate the inalienable rights thesis, I.E. That there is at least one inalienable right. Various senses of 'natural right' and 'inalienable' are analyzed so as to further clarify what is or could be the meaning and the truth of that thesis. A widespread confusion between the meaning of the terms 'inalienable natural right' and 'indefeasible natural right' is dispelled. It is concluded that present thinking about inalienable natural rights does not reveal precisely (...) why and in what sense there is such a right. Play requires security from sober concems, and only recently have non-native North Americans feIt secure enough in wildemess lands to view them as potential playgrounds. Employing a pretend quality of play illusion, many kinds of play are derivatives from normally sober activities. I argue that the most genuine sorts of wildemess play derive from the activities of the original geographical explorers. It is thus possible to distinguish types of play for which wildemess is especially suited from types that merely happen (...) in the wildemess-i.e., for which wildemess is an accidental playground. Play values are important enough to receive serious consideration in the administration of wildemess lands, and Iconclude that our public policy ought to favor wildemess activities that most closely imitate the activities of the original geographical explorers. The central purpose of this paper is to examine the case for political authority, i.e., the argument for having political authority rather than for having none. Thus, the case for political authority is the case against anarchism. My construction of that case owes much, no doubt, to observations made long ago by Thomas Hobbes and john locke. Nevertheless, these observations have never been stated in a satisfactory and systematic fashion, not even by Hobbes and locke themselves. Hobbes’ observations have, more (...) often than not, been misunderstood, and those of locke have generally been overlooked. However, this paper is not intended to be an exercise in the history of political philosophy. Rather, it is an assessment of a philosophical thesis, namely, that political authority is essential to man's survival and well-being. Although this thesis is rarely contested and, in fact, borders on the commonplace, it is contestable. Moreover, since disenchantment with authority and how it is exercised is growing, an examination of how men are likely to fare in its absence is appropriate. As the Zika virus pandemic continues to bring worry and fear to health officials and medical scientists, Centers for Disease Control and Prevention (CDC) and World Health Organization (WHO) have recommended that residents of the Zika-infected countries, e.g., Brazil, and those who have traveled to the area should delay having babies which may involve artificial contraceptive, particularly condom. This preventive policy, however, is seemingly at odds with the Roman Catholic Church’s position on the contraceptive. As least since the promulgation of (...) Paul VI’s 1968 encyclical, Humanae Vitae, the Church has explicitly condemned artificial birth control as intrinsic evil. However, the current pontiff, Pope Francis, during his recent visit to Latin America, remarked that the use of artificial contraception may not be in contradiction to the teaching of Humanae Vitae while drawing a parallel between the current Zika Crisis and the 1960’s Belgian Congo Nun Controversy. The pope mentioned that the traditional ethical principle of the lesser of two evils may be the doctrine that justified the exceptions. The authors of this paper attempt to expand the theological rationale of the pope’s suggestion. In so doing, the authors rely on casuistical reasoning as an analytic tool that compares the Belgian Congo Nun case and the given Zika case, and suggest that the former is highly similar to, if not the same as, the latter in terms of normative moral feature. That is, in both cases the use of artificial contraception is theologically justified in reference to the criteria that the doctrine of the lesser of two evils requires. The authors wish that the paper would provide a solid theological-ethical ground based on which condom-use as the most immediate and effective preventive measure can be recommended in numerous Catholic hospitals as well as among Catholic communities in the world, particularly the most Zika-affected and largest Catholic community in the world, Brazil – 123 million present Brazilian citizens are reported to be Roman Catholic. The paper attempts to set a guideline to contemporary common morality debate. The author points out what he sees as two common problems that occur in the field of comparative cultural studies related to a common morality debate. The first problem is that the advocates and opponents of common morality, consciously or unconsciously, define the moral terms in question in a way that their respective meanings would naturally lead to the outcomes that each party desires. The second problem is that (...) the examples each party chooses as the empirical evidences may not be as simple and clear-cut as the researchers think they are, mainly because the situational contexts where the examples are located between two different cultures vastly differ. To prevent these mistakes, the author emphasizes that we should pay attention to a subtle distinction between "thick" and "thin" construed from the levels of "theoretical status" and of "material content". With the conceptual distinctions in mind, the author shows how different cultures (i.e., Western individualist society and East Asian neo-Confucian society) see the moral principles like autonomy and beneficence in different lexical orders. In the present paper we argue that the theory of contracts embraced by many libertarian scholars and relied upon by them in sundry important debates (e.g. over morality of the fractional reserve banking or loan maturity mismatching etc.), that is, the title transfer theory of contracts (TTT) should be rejected as not being able to account for the binding force of future-oriented contracts, including contracts deemed enforceable by those scholars themselves. The TTT claims that the only contracts that should be (...) legally binding are these where the debtor’s failure to abide by them constitutes a violation of the creditor’s private property rights. However, as we argue, no default of the debtor in a future-oriented contract can in itself amount to such a violation. (shrink)

In Plato's Euthyphro two suggestions are offered to account for the accusation of impiety brought against Socrates. The first comes from Euthyphro , who takes it that the accusation is directed primarily against Socrates' ‘divine sign.’ The second is made by Socrates himself , who puts forward the view that he is being brought to trial because he refuses to accept such tales about the gods as Hesiod told regarding the maltreatment of Uranus by Cronus and of Cronus by Zeus—tales (...) which Euthyphro not merely believes but regards as justifying his action in prosecuting his own father. Both these suggestions used to be taken at their face-value, as, for example, by Grote . But according to J. Burnet , followed by A. E. Taylor , neither is meant to be taken seriously. (shrink)

The continuity between the common practices and aesthetic ones determines the significance of ordinary objects if they are linked to a project of enrichment and fulfillment of experience. A case that thematizes the richness of these practices in the contemporary world, and also the related theoretical and critical (...) problems, is the production of skateboards. This article looks at liberalism as a political tradition encompassing competing and, at times, incommensurable values. It looks in particular at the potential conflict between the values of free speech and equal respect. Both of these are foundational values for liberalism, in the sense that they arise as normative ideals from the very inception of the liberal tradition itself. Yet from the perspective of this tradition, it is by no means clear which of these values should be prioritized in those (...) instances where they come into conflict. This article insists that the only way these two values can be meaningfully weighed against each other is if their competition can be understood within the broader framework of liberalism and democracy. Within this broader framework it is possible to find criteria which enable us to choose between these values in a non-circular manner — i.e. in ways which do not already presuppose a commitment to the value we wish to support. Evidence‐based interventions have been developed and used to prevent HIV infections among black men who have sex with men (MSM) in Canada and the United States; however, the degree to which interventions address racism and other interlocking oppressions that influence HIV vulnerability is not well known. We utilize integrative antiracism to guide a review of HIV prevention intervention studies with black MSM and to determine how racism and religious oppression are addressed in the current intervention evidence base. We searched CINAHL, (...) PsychInfo, MEDLINE and the CDC compendium of evidence‐based HIV prevention interventions and identified seventeen interventions. Three interventions targeted black MSM, yet only one intervention addressed racism, religious oppression, cultural assets and religious assets. Most interventions' samples included low numbers of black MSM. More research is needed on interventions that address racism and religious oppression on HIV vulnerability among black MSM. Future research should focus on explicating mechanisms by which multiple oppressions impact HIV vulnerability. We recommend the development and integration of social justice tools for nursing practice that aid in addressing the impacts of racism and other oppressions on HIV vulnerability of black MSM. Usually scholars think of Marvin Farber as an American pupil of Husserl and his figure is given historical and institutional credit. It is also said that his thought misrepresented the intentions of the master and that his idea of a naturalization of phenomenology was devoid of hermeneutical grounds. All this has fed the myth of his heresy, the idea that his philosophical proposal could be summarized as a deviation from the orthodox canon. In this paper the legitimacy of this (...) perspective is widely discussed. Is it really correct to think of him as a child of the phenomenological continental tradition transplanted on American soil? Or would it not be more fruitful to consider him, beyond the canon, as an American philosopher fully immersed in the epistemological debates of his time? The paper argues in favor of this way of interpretation, discussing Farber’s own theoretical proposal in conjunction with the ecosystem of the American philosophical history. (shrink)
